The Act defines an “exceptional pupil” as one “whose behavioural, communicational, intellectual, physical or multiple exceptionalities are such that he or she is considered to need placement in a special education program.” The Ministry is therefore responsible for requiring school boards to implement procedures for identifying student needs, and for setting standards for identification procedures. Under the Act, the Ministry of Education is responsible for ensuring that all exceptional children in Ontario have available to them appropriate special education programs and services without payment of fees. Currently, there are 72 district school boards in Ontario: 31 English-language public boards, 29 English-language Catholic boards, 4 French-language public boards, and 8 French-language Catholic boards. These schools are administered by local school boards throughout the province. Publicly funded elementary and secondary schools are governed by the Education Act (the “ Act”) and its accompanying regulations.
In the 2001-02 school year, over 2 million students attended publicly funded elementary and secondary schools in Ontario.
